چکیده فارسی مقاله حق یکی از مهم‌ترین ادعاهای بنیادینِ هنجاری است که نقشی محوری در تحولات چند صد ساله اخیر در حیات فردی و جمعی آدمیان در سراسر جهان ایفا کرده است. این مفهوم و نهاد، همانند هر مفهوم و نهاد هنجاری، نیازمند موجه‌سازی است. با این حال، موجه‌سازی حق، به سبب چیستی خاص آن، بسیار دشوار می‌نماید. آیا حق بر بنیاد اخلاق بنا می‌شود؟ برای پاسخ دادن به این پرسش، نخست باید از چیستی امر اخلاقی و نیز چیستی حق پرسید. پرسش از چیستی آن دو، به ویژه اخلاق، ناگزیر بحث را به وجوه مشترک و تمایزبخش آنها از دیگر حوزه‌های مشابه سوق می‌دهد. نقطه تمرکز این نوشتار اما بر ابعاد متمایزکننده امر اخلاقی و حق است. پس از معرفی وجوه ممیّز «امر اخلاقی» و «حق»، رابطه منطقی میان این دو را در زمینه موجه‌سازی یا دفاع نظری از حق تحلیل و ارزیابی خواهیم کرد. این تحلیل و ارزیابی زمینه شناخت و به کار گیری دقیق‌تر مفاهیم یادشده را فراهم خواهد آورد.

چکیده انگلیسی مقاله Rights are among the most important fundamental normative claims that have played a pivotal role in the development of individual and social lives of human beings over the last centuries. This concept and institution, the same as any other normative concept and institution, is in need of justification. However, justification of rights, due to their particular nature, seems to be too hard. Are rights established on the basis of morality? In order to answer this question, it is first imperative to inquire into the nature of the moral and also that of rights. Inquiring into the nature of them, in particular that of morality, shall inevitably lead the discussion towards the common and distinguishing features of them from similar fields. This paper is, however, focused on the differentiating dimensions of the moral and rights. Having introduced distinguishing features of "the moral" and "rights", we shall investigate and conclude on the logical relationship between the mentioned two in the context of justification or theoretical defence of rights. Such investigation and conclusion will pave the way for a more precise understanding and application of the aforesaid concepts.
